Car Rental

1. Purpose of the agreement

In accordance with the terms and conditions set forth in the agreement, the lessor undertakes to rent to the lessee, specified in the special terms of the agreement, the car specified in the agreement (hereinafter referred to as the car), and the lessee undertakes to receive the car, pay the rental price for it and use the car for its intended purpose and to fulfill other obligations specified in the agreement.


2. Rental period

The car is rented out (made available for use) to the lessee for the period specified in the agreement (hereinafter referred to as the rental period).

By agreement between the parties, the rental period may be extended by changing the entries in the "Extended to" section of the agreement.

The lessor must retain the reserved car for no more than 2.0 hours after the agreed rental start date.

If the car is not returned within 24.0 hours after the expiry of the rental period specified in the agreement, and the period has not been extended, and there are no objective reasons for the delay, the lessor shall contact the police regarding the theft of the car.

The lessor has the right to terminate the agreement before the specified deadline if the lessee does not comply with the terms of the agreement and/or does not fulfill their obligations.


3. The lessee undertakes

To accept and return the car at the agreed place by signing the acceptance and delivery document in the prescribed form, to use and maintain the car in accordance with standards, technical conditions and other documentation established by the company's manufacturer. Before starting to use the rental object, you must visually check its technical condition, and if any defects are detected, you must immediately inform the lessor.

The lessor must be informed no later than within 24.0 hours about damage to the car, theft or technical malfunctions, and stop using the car if further use may worsen the car's condition.

Not to transfer the car to third parties not specified in the agreement without prior agreement.

Protect the car, keep it locked, turn on the alarm, do not leave the windows open, do not leave the ignition keys, car documents or other valuables in the car's interior.

Use only the correct fuel, ensure correct tire pressure, monitor the amount of lubricants, coolant and engine temperature.

The lessee and driver must comply with traffic rules, only use the car for its intended purpose, not transport flammable or dangerous substances, drugs or other objects that are prohibited to store and transport by law, not participate in races, not use it as a training or taxi car.

Ensure that the car is not driven by persons who do not have a valid driver's license.

Comply with the insurance rules specified in this agreement. If the damage caused by an insured event to a third party exceeds the amount of liability insurance, the missing amount that covers the losses is paid. In an insured event, the franchise guarantee of NOK 20 000 is covered. In an uninsured event (e.g., driving under the influence, theft of the car with documents, etc.), the losses caused by the lessor and third party are covered.

In case of breakdown of the car, repair it only at the lessor's recommended garage (service offering warranty service). The lessor does not cover the costs of repairing the car if the breakdown occurred due to the lessee's fault, negligence or intent, and in these cases the costs are not covered by insurance, and warranty service is not offered, or the car was repaired at a garage not specified by the lessor.

The lessee must take all possible precautions to have the car repaired in the shortest possible time.

The lessee is in all cases responsible for damage caused by the lessor and/or third parties if they have violated the procedure for using the car specified in this agreement, used it in a technically unsafe condition, transported unauthorized objects in it, given the car to a person who does not have such a right, and the damage is not covered by insurance.

Use the vehicle for illegal purposes or in an illegal manner, including but not limited to the following examples of illegal use: Driving under the influence of alcohol and/or drugs and/or in an impaired condition. Carrying more passengers and/or heavier loads than the vehicle is registered for. Disturbing, removing or changing the vehicle's equipment, accessories or specifications, including but not limited to odometer, toll tag, charging cable, media installations, etc. Handing over the vehicle to others or allowing it to be driven by a driver other than that approved by the lessor. Using the vehicle for competition, speed testing or other forms of test driving. Using the vehicle for practice driving. Taking the vehicle out of the country, unless written consent from the lessor has been obtained. Carrying passengers for payment. Parking at rooftops where there are signs for snow slides or where there is obvious danger of snow slides. Using snow chains or other equipment in such a way that they damage the vehicle's body or chassis. Driving in areas unsuitable for the vehicle's height, width or length. Driving off public roads or in areas closed to public traffic. Towing, pushing or moving another vehicle. Leaving the vehicle unlocked or in such a way that it can be used by others. Filling with the wrong fuel. Exposing the interior to heat, sharp objects, liquids or anything else that may cause damage or stains. Driving with too little air in the tires, so that tires or rims are damaged. Incorrect use of jumper cables on the car.

International driver's licenses must be presented for citizens from countries outside the EU.

Ensure that all drivers are over 18 years old and have held a valid driver's license for at least 1 year.


4. The lessor undertakes

To hand over the car for use at the agreed place by signing the rental agreement without a driver in the prescribed form.

To ensure that the car is technically sound and suitable for use for its intended purpose.

To inform the customer about existing defects, scratches and other damage to the car.


5. Car insurance

The car is insured with Partial Comprehensive insurance with an excess of up to NOK 20 000.

Extra insurance with an excess of NOK 0 can be selected according to car type and number of days. Extra insurance applies for at least 3 days of rental.

The lessee must inform the lessor within 24 hours of an insured or uninsured event.

The lessee must immediately inform Narvik Rent A Car of an insured event.

The lessee must comply with the insurance company's rules.

For technical problems or when roadside assistance is needed, the lessee pays an excess of NOK 2 000.

Roadside assistance is included in Partial and Full Comprehensive insurance.

For windshield damage, the lessee pays an excess of NOK 3 000.

If the rental car is destroyed and must be repaired, and the lessee has no other car to replace it, the lessee must use their own travel insurance to continue traveling.


6. Liability of the parties

The lessor is not responsible for damage caused by the car to third parties;

The lessor is not responsible for loss, damage or theft of items that the lessee has left in the car;

If the lessor incurs expenses related to paying taxes and fines to third parties due to the lessee's fault, the lessee undertakes to reimburse the lessor for these;

The lessor is not responsible for the lessee's losses resulting from not being able to use the car in case of its failure, an accident, a delay in returning the car or similar. However, the lessor takes all possible measures to protect the lessee's interests and undertakes to cooperate in good faith. If the car breaks down without the lessee's fault, and the return of the car is delayed for this reason at the time specified in the agreement, the lessor does not charge the rental price for the delay.

In case of loss of car documents and/or ignition keys, the lessee must pay a fine of NOK 5 000.

Administration of fines, unpaid parking fees and road tolls NOK 300.

If the lessee fails to notify the lessor that they are leaving Norwegian territory, a fine of NOK 5 000 applies.

Each of the parties is fully or partially exempt from liability in case of force majeure circumstances that the parties could not foresee in advance when entering into or signing the agreement.


7. Returning the car

The lessee undertakes to return the car to the address specified in the agreement within the expiry of the rental period specified in the agreement. If the car is not returned on time, the daily rental price specified in the agreement is charged for the delay.

The lessee must return the car with the same amount of fuel as when the car was received. In other words, with a full fuel tank.

The lessee must return the car clean both inside and outside, otherwise the lessee must pay between NOK 500-2 000 for washing and cleaning the car. If the seats are stained or otherwise dirty (e.g., cleaning after dogs or smoking, cleaning of seat/seat covers, or after driving on gravel, fresh asphalt/road markings, clay, mud or other interior or exterior dirt requiring extra work), an additional fee of NOK 2 000 must be paid for dry cleaning.

The car must be returned in the same technical condition as it was at the start of the rental period, taking into account normal wear and tear. Any faults, defects and discrepancies in the equipment are stated in the car handover and delivery document.

The lessee must also return the vehicle documents and car keys handed over to them.

If no faults, defects in the equipment or other breaches of the agreement are detected, including fines, additional charges, tolls and the like, the lessee will have the deposit refunded within 20 business days.


8. Payments

Before handing over the car to the lessee, the deposit specified in the agreement must be paid. This depends on car type and rental period. The amount varies from NOK 1 000 to NOK 10 000. The deposit amount is written in the rental contract and may be part of the total payment. The deposit is not refunded if the lessee does not pick up the car at the time specified in the agreement, or cancels the rental less than 48 hours in advance.

For short-term rentals (up to one month), the rented car is paid for in advance, before the car is handed over for use according to invoice or direct payment.

The contract price applies for driving up to 200 km per day (driving distance). The number of kilometers allowed to drive, included in the price, is calculated as the average distance traveled per travel day. If this allowed driving distance is exceeded, the lessee must pay NOK 4 for each extra kilometer driven (unless otherwise specified).

The lessee shall also be responsible for additional rental services (if the rental period was longer than specified in the agreement), fines and losses specified in this agreement.

The lessee accepts that the lessor may charge the lessee's credit card, debit card or deposit for all amounts the lessee is responsible for under the rental contract and any charge is made without prior notice. In case of any damage, the excess is charged to the specified payment method, and the lessee is responsible for claiming a refund from their own insurance company in cases where the lessee has taken out insurance through parties other than Narvik Rent A Car AS.


9. Dispute resolution

The parties base their relationship on the principle of cooperation in good faith and agree that all disputes shall be resolved through negotiations.

If the dispute cannot be resolved through negotiations within one month, the dispute shall be referred to the relevant court for resolution in accordance with Norwegian law.


10. Exchange of information

All notices related to this agreement must be written in English or Norwegian.

The notice shall be deemed given on the date of receipt.


11. Entry into force and amendment of the agreement

The agreement enters into force on the date of receipt and shall be valid until the parties have fully fulfilled their obligations.

Amendments to the agreement may only be made by separate written agreement.

If the information provided about the lessee is incorrect, or the person receiving the agreement does not agree with the information specified in the agreement, the lessee must provide correct and relevant information, which will be used in case of fines or insurance.
